As of November 1, 2008 any organization that issues credit by providing services in advance of billing (this includes hospitals) must implement an identity theft prevention program to be in compliance with the Red Flags provisions of the new Fair and Accurate Credit Transactions Act (FACT Act or FACTA).  Although enforcement actions will not begin until May 1, 2009, you may still have a liability for failing to comply by the November 1, 2008 date if an incident of identity theft occurs and you do not have a program in place to detect red flags and prevent identity theft.  You need to prepare now.
