For organizations operating in highly regulated industries such as Healthcare and Financial Services, the need for implementing a compliance program is well understood.  Whether it is the Patient Protection and Affordable Care Act or the Dodd-Frank Act, there is increasing regulatory scrutiny and an emphasis on compliance.   Significant compliance guidance from various government agencies has been issued over the years with recommendations for structuring a compliance program and the elements that should be included.  The recent modifications to the Federal Sentencing Guidelines, which went into effect on November 1, 2010, included provisions that set forth the attributes of effective compliance and ethics programs. 

The focus of regulators has now shifted from looking for evidence of the existence of a compliance program to proof that demonstrates the effectiveness of the compliance program.  Regulators are raising the stakes by asking the question – “Can you prove that your compliance program works?” with an emphasis on effectiveness and measuring the quality of outcomes.  These outcomes include:  evidence of promoting an ethical organizational culture, proactive monitoring for and detection of non-compliant activity, management’s response to compliance violations, and enforcement of disciplinary actions.
